Public Officials Liability provides protection against allegations of wrongful acts, such as sexual harassment and employment practices. Our coverage applies to governing bodies and staff, special enforcement officers outside the control of the Sheriff. Because state law requires that Constitutional Officers obtain coverage through the state plan, VaRISK, our coverage does not extend to them. However, VAcorp makes available liability coverage excess of the limits provided through VaRISK.
This type of coverage is a combination of programs commonly known as Errors and Omissions and Directors and Officers coverage in the traditional insurance industry. However, because we work only with a niche group in the public sector, we tailor our coverage to cater to the specific needs of our members. We include coverage for defense costs for certain excluded wrongful acts, including fraud and dishonesty, profit and gain, violation of statute, failure to maintain insurance, breach of fiduciary duty, breach of contract, and land use/eminent domain. We even provide defense coverage for administrative complaints from the Office of Civil Rights (OCR) and Equal Employment Opportunity Commission (EEOC) before they become lawsuits.
