Excess Liability Protection for Constitutional Officers
Constitutional Officers are automatically afforded liability protection through the Virginia Division of Risk Management’s VaRISK program. This is required by law per §2.2-1839 of the Code of Virginia. However, sometimes an additional layer of protection is desired.

VAcorp can provide protection for Constitutional Officers through optional additional coverage limits that are secondary, or in excess of the coverage program provided by the state. This unique coverage provides an additional layer of liability protection for these elected officials and their staff when the coverage limit provided by the required state plan is exhausted. This VAcorp coverage provides secondary protection against liability claims, suits, or allegations of property damage, bodily injury, or wrongful acts, such as sexual harassment and employment practices.
Regional jails are given the opportunity to opt out of the VaRISK program, although the state assesses a cost for this. For regional jails that have opted out of the VaRISK program, VAcorp provides comprehensive primary liability protection for all covered liability claims against the jail, its board, officers, and staff.
